Monthly Board Meeting
Tuesday, December 13, 2022

 Please Note:  These Town Board meeting minutes are posted as draft-only to inform town residents of the topics addressed at the board meeting.  These minutes are subject to review and possible revision at next month’s Town Board meeting and should not be considered official until they receive final board approval at that time.

The meeting was called to order at 7:03 pm.  The meeting was held in person and as a video conference on Zoom.  Chairman Dan Truttmann, 1st Supervisor April Prusia, 2nd Supervisor Travis Leonard, and Clerk-Treasurer Jessie Schlumpf were present.  Verification of proper notice was given.

Public Comment-  Jessie Schlumpf thanked her Post-election Equipment Audit workers; the audit confirmed that the voting machine tabulated ballots correctly for the 11/08/2022 election.

Minutes of 11/09/2022 Budget Hearing, Special Meeting to Adopt Tax Levy, and Town Special Meeting and 11/09/2022 Town Board Meeting-  Minutes for the Wednesday, 11/09/2022 Budget Hearing, Special Meeting to Adopt Tax Levy, and Town Board Special Meeting were presented.  Dan Truttmann moved to approve the 11/09/2022 Budget Hearing, Special Meeting to Adopt Tax Levy, and Town Board Special Meeting minutes as presented; second by April Prusia.  Motion carried.  Minutes for the Wednesday, 11/09/2022 Board Meeting were presented.  Dan Truttmann moved to approve the 11/09/2022 Town Board meeting minutes as presented; second by Travis Leonard.  Motion carried.

Treasurer’s Report –  The Treasurer’s Report was presented.  Dan Truttmann moved to approve the Treasurer’s Report as presented; second by April Prusia.  Motion carried.

Bills-  Jessie Schlumpf presented bills to be paid.  Travis Leonard moved to accept the bills as presented; second by April Prusia.  Motion carried.

Patrolman’s Report-  Lance Moen reported that fire extinguishers have been installed in all the vehicles.  A couple of signs were recently stolen – Farmers Grove and York Center, and those replacement signs have been ordered.  He has been taking down dead trees.  Lance received questions from residents about the possibility of having a large dumpster at the Recycling Center for overflow trash as well as oversize trash items (pick up would be on an as-needed basis and could reduce the number of additional pickups of trash by Pellitteri).  He has fixed the hydraulic hose on the plow truck and reported the first snow plowing went well.

Weed Commissioner Report-  Aaron Gifford had nothing to report.

Plan Commission Report-  Bethany Storm had nothing to report beside the discussion of Plan Commission recommendations to be covered later in the agenda.

Business Items-

Dept. of Revenue – Nipple BOR appeal(s)-  Jessie Schlumpf reported on her conversation with Kathryn Soto-Moreno of the Dept. of Revenue.  A York Board member does not need to attend the Informal Conference on 1/04/2023 at 9:00 a.m.; usually attending are the people appealing and the assessor.  Since York has contracted with a new assessor, Dan Truttmann will contact our new assessor, Associated Appraisal Consultants, for guidance.

Thank you gift to Carrie Czerwonka for newsletter work-  Dan Truttmann moved that we give a gift certificate of New Glarus Chamber Bucks in the amount of $150.00 to the Czerwonka family; second by April Prusia.  Motion carried.

Robert & Lori Schaefer driveway permit – N8824 Hay Hollow Rd.-  The Board discussed a proposed addendum to this driveway permit for filing with the Register of Deeds (if so desired).  Questions on driveway improvements were raised; the matter was tabled until next month.

Kendall Syse driveway refund-   Travis Leonard moved to approve the Kendall Syse driveway refund on Sunnyside Rd.; second by Dan Truttmann.  Motion carried.

Set January 2023 caucus date-  The Board discussed dates and notice requirements.  Travis Leonard moved to set January 10, 2023, at 7:00 p.m. as the caucus date; second by Dan Truttmann.  Motion carried.

Clerk/Treasurer posting and interview process-  An interview was conducted before the regular Board meeting; the Board will put together an offer.

Part-time plow truck posting and interview process-  Dan Truttmann reported receiving a call from an applicant.  Travis Leonard will speak with the applicant about job requirements.  Dan Truttmann moved that we offer $20/hour starting wage to a part-time plow operator; second by April Prusia.  Motion carried.

Solicit plow truck bids-  Travis Leonard is still working on options.  Lance Moen, Dan Truttmann, and Travis will inspect other town’s equipment storage buildings while looking at other towns’ trucks (e.g., Moscow).  Delivery time is 18-24 months from order date.

ATV/UTV ordinance-  The Board had asked Jessie Schlumpf to create a red-line draft of the proposed ordinance incorporating revisions suggested by counsel.  Travis Leonard moved to approve Ordinance #2022-2 regarding All-Terrain Vehicle and Utility Terrain Vehicle Routes and Regulations in the Town of York; second by April Prusia.  Motion carried.  The Board discussed route options.  Dan Truttmann moved to amend “Section D.1) Routes” to read:

1) Routes. Only the following roads are designated as routes under this ordinance:

a. Gould Hill Road, from the Town line to Yankee Hollow Road,
b. Yankee Hollow Road, from Gould Hill to County Hwy A, and
c. Vinger Road, from Yankee Hollow Road to the Town line.

The Board had further debate including reviewing in a year.  Dan Truttmann moved to close debate; second by April Prusia.  April Prusia seconded the motion to amend Ordinance #2022-2 “Section D.1) Routes.”  Motion carried.

Dan Truttmann moved to amend “D.3) Local Regulation, d.” to read:

3) Local Regulation:

d. All ATV and UTV operators on any portion of a designated route shall not exceed 35 miles per hour, unless a reduced speed is otherwise required by law or roadway conditions. Separate speed limit signs for ATV’s-UTV’s will be required.

Second by Travis Leonard.  Motion carried.

Dan Truttmann moved to amend “D.6) Penalties, a.” to read:

6)  Penalties:
a. Any person who violates this ordinance shall forfeit not less than $50.00 nor more than $500.00 for each offense, plus court costs.

Second by Travis Leonard.  Motion carried.  Dan Truttmann called for a vote on the amended ordinance:  Dan Truttmann – Aye, April Prusia – Aye, Travis Leonard – Aye.  Motion carried.

Discuss and consider for action recommendations from plan commission regarding land division ordinance and related actions-  The Board discussed the need for planned growth in the Town of York and the Plan Commission’s recommendations regarding property development rights (also known as dwelling units) on parcels of at least 35 acres (currently at 20 acres).  The recommendations were discussed at length.  Dan Truttmann moved that we hold a public hearing regarding the Plan Commission recommendations about the land division ordinance on Tuesday, 1/24/2023 at 7:00 p.m.; second by Travis Leonard.  Motion carried.

Adjournment-  Travis Leonard moved to adjourn; second by Dan Truttmann.  Motion carried.  The meeting adjourned at 9:52 pm.
