Public Hearing for Land Division-Development-Transfer Ordinance

The public hearing was called to order at 8:00 P.M. Present were Chairman Dan Reeson, 1st Supervisor Dan Truttmann, 2nd Supervisor Steve Hermanson, Clerk Nancy Anderson, along with Plan Commission members Curt Moen, Heidi Hankley, Terri Nipple, Brian Bubenzer, and Marselino Miranda. Seventeen citizens were also present. Verification of proper notice was given.
Introduction of Plan Commission members– Dan Reeson asked each member of the Plan Commission to stand and introduce themselves.
Presentation– Heidi Hankley led the presentation letting everyone know that the Land Division-Development Ordinance has been in effect for ten years, having been originally adopted on April 15, 2004. The vision statement for the Town of York serves to preserve as much farmland as possible. A database tracking system for dwelling unit allotments has been established up to the present. Amendments to the ordinance would allow the Plan Commission and the Town Board to track future land divisions and have a clear record of those transactions. According to Heidi Hankley, these amendments may not fit every land owner’s situation and may have to be “tweaked” a bit. Pat O’Neill and William Foster both thought their land might be exceptions to the amendments. Heidi noted that the Plan Commission will meet immediately following this public hearing, and specific situations could be addressed at that time. After reviewing all the new additions to the ordinance, it was thought that the language in section 7 b. of the eligibility requirements should be reviewed and section 7 d. should be removed from the document. The Town Board and Plan Commission will take a look at those areas again. A new Notice of Transfer form will also aid in tracking and recording dwelling unit allotments.
