Minutes of Public Hearing on draft Land Division Ordinance
Tuesday October 14, 2025
The meeting was called to order by Dan Truttmann at 7:04 pm. The meeting was held via video conference on Zoom and in person. Chairman Dan Truttmann, 1st Supervisor Travis Leonard, 2nd Supervisor Aaron Gifford, and Clerk-Treasurer Brenda Hackbart were present. Verification of proper notice was given.
Dan Truttmann read the guidelines for public input at meetings and introduced town attorney, Larry Konopacki, to assist with providing answers and clarifications on the draft Land Division ordinance. Dan Truttmann read an email from Charlie Umhoefer on behalf of Plan Commission thanking all for thoughtful work on this ordinance. Dan provided clarification on section 7 as the main update to the ordinance.
Public Comments:
Curtis Moen asked questions regarding transferring items as noted in section 7 of the ordinance, including asking for definition of property. Larry Konopacki explained difference between ‘property’ and ‘parcel’; and clarified transfer details. Curtis shared concerns over property value due to type of land category and which land division version referenced.
Dan Reeson expressed belief in existing ordinance was working well.
Travis Thompson questioned if purpose of new ordinance was to preserve farmland. Dan Truttmann explained existing draft didn’t differentiate between productive vs non-productive land and didn’t provide the town with the ability to limit development on farmland. Larry Konopacki added that he strongly recommended the existing ordinance required improvement on regulating dwelling units, land divisions, etc. since town doesn’t have our own zoning.
Jason Rowley referenced the soil map, asking about productive land remaining and Dan Truttmann replied in the affirmative indicating there’s both.
Brian Bubenzer asked if the town currently has the infrastructure to track and enforce the ordinance. Dan Truttmann stated this is the next step and has contacted Vierbicher to possibly develop a database to track when splits occur.
Dan Reeson, Curtis Moen and Travis Thompson gave examples and asked for clarification on deed restrictions, cluster of homes, and forest lands. Larry Konopacki explained when deed restriction would be necessary vs unable to force, how current county ordinance and zoning applies vs when town ordinance applies, and Dan Truttmann gave clarification on forest lands and unproductive lands.
Curtis Moen asked for clarification on the 5-year moratorium in the previous ordinance and how this impacts duplexes. Dan Truttmann and Larry Konopacki explained the intent of the 5-year and why it changed; and Larry stated up to county regarding zoning and building duplex.
Travis Thompson asked about timeline to approve draft ordinance. Dan Truttmann stated it was ready for approval and might be voted on tonight.
David Erickson shared concerns on land value impacted by change in number of homes available based on draft ordinance. Dan Truttmann explained this gives incentives for owners to utilize non-productive land for splits and can provide options for owners to maximize productive vs non-productive lands.
Nancy Schowalter thanked the board and those involved for the logical upgrade to land divisions.
